Judge gives props—and a fine to superhero protesters

Steve McIntosh said the protest staged by Paul Fisher of Columbus and Donald Tenn of Sacramento, Calif., may indeed have been effective. But it was also illegal—and expensive.

A year ago, Fisher and Tenn—dressed as Spider-Man and Superman—climbed a 200-foot crane sitting at a construction site near Ohio Stadium and hung a massive “Stop the war on fatherhood” banner as 100,000 people streamed by on their way to Ohio State’s football game against Minnesota.

The dangerous duo recently pleaded guilty to criminal damaging in front of McIntosh, a Franklin County common pleas court judge.

The protest may have been “effective in educating people,” said McIntosh. But he quickly added, “Where I had a real problem was that the company they inconvenienced had absolutely nothing to do with their cause.”

As part of their plea agreement, Fisher and Tenn must pay the contractor who was renting the crane $5,500 in restitution—an amount equal to the crane’s rental fee, plus the cost to have the crane they climbed inspected. McIntosh suspended a 90-day jail sentence and placed both men on probation for one year.

The nonprofit organization both men are associated with, Fathers 4 Justice, began in 2004 as an advocacy group for better treatment of fathers within the family court system. It doesn’t, however, endorse illegal demonstrations such as the one performed by Tenn and Fisher, said Brian Holladay, Ohio’s state coordinator for Fathers 4 Justice.

“We can’t even say we approve or disapprove or we like or dislike it,” he said.”

Despite that, Holladay can’t deny that the incident created a buzz for his organization.

“It makes an impact. It’s definitely raising public awareness because it gets people excited—it gets them involved,” Holladay said.

The men said they were trying to do exactly that. But awareness doesn’t necessarily equate to change.

“You can protest and there are means of protesting—we have people in front of the courthouse regularly exercising their First Amendment rights—I don’t know there’s any particular way of doing it. Could they have accomplished the same thing by walking around with the banner instead? I don’t know.”

“In this country, many changes have come from protest,” said McIntosh. “But I think it’s rare a single protest causes change.”

(Note: this is a judge saying a single protest won't cause the change we seek. I don't interpret this as minimizing the protest, just stating the obvious. If you want this effort to count for something it must be the start of something bigger. -pf)

Fisher and Tenn both say they have suffered at the hands of a family court system that often favors the mother over the father when it comes to visitation rights. Tenn, president of the U.S. chapter of Fathers 4 Justice, said he hasn’t seen his 6-year-old daughter, Madison, since 2007, after his ex-wife filed a restraining order against him. Fisher has been fighting for more than his allotted four-days-a-month visitation time with his daughter, Demetra, 7.

Two fathers who staged a protest at a Buckeyes football game last year to complain about the way dads are treated by family courts pleaded guilty this morning to criminal charges.

Dressed as superheros, Donald Tenn and Paul D. Fisher climbed a 200-foot crane at Lane and Neil Avenue last September to unfurl a banner for their cause. Fisher, of Columbus, dressed as Superman and Tenn, of Sacramento, Calif., dressed as Spider-Man.

They were charged with felony vandalism counts for the stunt, which lasted three days.

As jury selection continued today, prosecutors and defense attorneys reached a plea deal which would put the men on probation and pay the contractor $5,500 - restitution for the cost of renting a replacement crane and inspecting the old one.

Both pleaded guilty to misdemeanor charges of criminal damaging in Franklin County Common Pleas Court.

Judge Stephen L. McIntosh suspended a 90-day jail sentence and placed both men on probation for one year.

"Everything I do is for my daughter," said Tenn, 53. He said he has not seen his 6-year-old daughter, Madison, since 2007 because his ex-wife moved to a small town in Illinois and filed a restraining order against him.

Tenn is the president of the U.S. chapter of Fathers4Justice. He said his protests around the country are aimed to raise awareness to the plight of split couples who face separation from their children.

He came to Columbus to help Fisher, 32, who has objected to Ohio's system of deciding child visitation issues. Fisher has fought for more visitation with his daughter, Demetra, 7.

"I get four days a month with my daughter," Fisher said, choking back tears. "Donald and I did something about it."

McIntosh told the men that although their issue is honorable, they could have caused a panic and did cause financial harm to local contractors at an Ohio State University parking garage site.

Donald Tenn of Sacramento, California is taking creative measures to ensure his Christmas gifts are delivered to his daughter in Moultrie County, Illinois.

He is asking Illinois Judge Flannell, who refuses to enforce his California visitation orders, to make the delivery for him.

Donald's partner, Shannon Phillips took their daughter 2,089 miles away to visit family in Illinois. She never returned.

Using his daughter as collateral, Phillips asked Tenn to move their small family to Illinois. His insistence that the family home was in Sacramento, where the pair has agreed to conceive and raise their child, was met with allegations of domestic violence, and the resulting restraining order.

Despite Tenn's unrelenting efforts, and new legal orders from California that demand he have visitation with his daughter, Phillips has only permitted one visitation in nearly three years.

Illinois states attorney, Marvin Hanson, refuses to intervene on Tenn's behalf even going so far as to order the Moultrie county sheriff's office cease providing guardianship exchange assistance to Tenn. Meanwhile, Phillips actions are endorsed by her patron, Dove Inc., a religious organization that generates revenue from the Violence Against Women Act.

Federal taxpayer dollars have funded the alienation of Madison from her father based on nothing but arbitrary emotions and opinions. The judiciary of Illinois has done nothing to protect Tenn's rights as a parent.

Micro Rally Cumberland County NJ

Friday 12/5/08 once again we were out in the cold on the street in NJ. Four of us were out in front of the Cumberland County Courthouse in Bridgeton. We did a mild introduction of the superheros. Of course we got the required appearance from the local police making sure that we were not there to start any trouble.

Jake Fransko and I dressed as Batman and Spiderman and stood on the street corner for about two hours in the early afternoon. Almost immediately we started attracting the attention of the public with both good and bad responses. Several people asked why we were in costume and once I explained that every child looks at their father as a superhero that got it and thought it was great. However, there is always at least one asshole in every crowd. We had one woman drive by and give us some not so nice hand gestures. She then drove around the block and approached Sam Ross who was on the opposite corner filming us. She proceeded to yell at Sam and tell him that we must have something to hide if we are wearing masks. We did not get that on film because Sam turned off the camera when she pulled up.

The truck belongs to Tony. He is an advocate for fathers and children in the family court.

This Wednesday is supposed to be the next rally in Camden County. I hope the weather holds out because the reports are now calling for heavy rain.

Gloucester County NJ Micro Rally 11/26/2008

Unfortunately, I am having trouble loading video so I have just a couple pictures. We started our rally at 8:30am in 38 degree weather. Within minutes we were confronted by a Sherrif's officer to make sure we were not there to start trouble. That is funny being at that time there was only two of us. Throughout the day there were three of us who had actually planned on the rally. We were able to make several contacts with some very interesting people. One gentleman actually went and bought us coffee. One other guy came and wanted to stand with us and hold a sign for about an hour. Jim and Patti went to the local newspaper to attempt to get an article in the paper. I will find out how that worked out and update everyone later.

Shortly after noon Jim and Patti had to leave due to work obligations. I stood out for a few more hours by myself. By the end of the day my hands were so cold they were numb. Next time I will be wearing gloves. We will be having our next rally on December 6th at the Cumberland County Court. Hopefully I will have more pictures and video for that one.

Pittsburgh Event deemed success, despite police actions

We left Ohio for Pittsburgh with 300 flyers of information, others united. Jeff Dick appeared with 500 flyers, and Jessie had an enormous amount as well.

The football fan attendance was amazing. My mind is still boggled by the amount of die-hard fans in the area.

I estimate that within 1-2 hours, we collaboratively distributed 700+ flyers.

Police Illegally Halt F4J Event in Pittsburgh

Jesse Storm, of F4J PA, was arrested on Sunday for videotaping security personnel removing F4J pamphleteers from a public sidewalk. The arrest occured during a Steelers game at Hienz Stadium in Pittsburgh.
Storm was detained by Sgt. John Fisher of the Pittsburgh Police for alledgedly of violating the wiretap laws of Pennsylvania.

"I tried to explain to him that we where on a public sidewalk and there was no assumption of privacy. Nevertheless, he handcuffed me," Storm stated. Storm was recording the event as an agent of "Daddy Justice Films," a media outlet that reports on pro-fatherhood events and activities.

"Security at the Heinz Field told us that we are not allowed be on the public sidewalks and the public property surrounding the Heinz field complex," explained Storm. The group of activist left the area while Storm and others discussed the issue with the authorities. "When the police showed up the issue changed. They were more concerned with my camera. Sgt. Fisher asked me to turn off the audio recording device. When I showed him that camera was turned off, he pulled the camera out of my hands and arrested me," stated Storm. Police officers and security then detained Storm in the stadium and confiscated his equipment.

Responding to the alarm of people involved in the event, District Attorney, Tom Corbet, demanded Storm be released from custody because he and the group had not violated any laws. "The D.A. instructed them to release me and said we are allowed to demonstrate on the sidewalks and to continue our rally," stated Storm. Storm was released immediately, but the camera and recording remain in police custody.

The Pennsylvania chapter of Fathers-4-Justice has had previous experience with police interfering with events designed to increase public awareness about the problems in family court. On August 30th Lancaster police conducted traffic stops on drivers who were supporting the F4J activists in response to signs reading, "Honk to support equal parenting." The police cited "improper use of a horn" as the cause for the stop. A video of the incident with police was posted on the internet and has raised concerns about freedom of speech violations.

After Storms release the group resumed the event but where halted once again. "Security stopped us again, insisting that we where not allowed on the public sidewalks or egresses around the field," says Storm.

Brian Holladay, a member of the F4J national board of directors, stated that event was still a huge success, despite the adverse challenges. People showed up from Ohio, Pennsylvania, and West Virginia with flags and signs. F4J activists walked the public parking lots and sidewalks handing out pamphlets and spreading the message of equal parenting "People were running after us to get our information," stated Holladay, "One guy chased me down to thank me for spreading the message. He has been fighting the family courts for 24 years."

When asked if anyone plans to press charges against the local authorities, Holladay said, “Our board of directors will discuses the issue this week.”

I was trading tips with the button sales people. Talk about making some cash, these people do very well. I could use some donations to purchase more flyers, or offers to run copies. It is a flyer printed on both sides then cut in half. So I get two flyers per sheet.

The best rate I can get at Kinko's Office is $50 for 600. I have to pay for the cut, that is what pushes the per unit cost up. Around 10¢ a flyer. I'm sure we can find a way to get this cheaper.

I actually had the opportunity to speak with Alaska Governor and Republican V.P. Candidate, Sarah Palin about the issue of father's being systematically exiled from their children.

The short version of the story is that I talked to one of her aids, asking why the campaign had not utilized Todd Palin's role as a stay at home Dad to reach father's who have been victimized by the family courts. I explained that we are a vast voting block, that hold this issue is so dear to us that most will cross party lines to vote for the candidate that acknowledges the issue. We want nothing more than what is already constitutionally guaranteed.

As Sarah was leaving the event and walking to her bus, she looked over to the area where I had spoken to her aid. It was obscure corner of the gated area, she was outside the perimeter. A crowd gathered immediately as she made a detour to where I was standing. The crowd started shouting for her and I was pressed against the railing. Her aids told the crowd that she was no longer autographing, but she shook a few hands, thanking people for support, and then she came over to me.

I grabbed her hand and held with both my hands. "Sarah, help us! Please stand up for fathers and our rights to raise our children. We are being stripped of our children without due process, it is epidemic. This is major issue in this state, and effects nearly everyone."

She did not respond with any statement of support, but I saw in her eyes the look I have seen so many times from mothers and grandmothers whom I have shared my story with. The look of disbelief and surprise, but also of genuine concern. We talked for a short while, I was content at having made direct contact. I can not be certain how she interpreted my statements, I hope that a degree of my sincerity permeated the pace of the environment. She shook another hand and turned to leave... That is when I thought to take some video, as I was alone.

No matter what you think of Palin, She is a mother, and now a grandmother. Once she clearly understands that good father's are being trampled by the family courts and false allegations on a massive scale, we may gain an advocate. She would not be able to be in the position she is if her husband, Todd Palin, was not at home supporting her and caring for their children.

We are not misogynists, we are loving fathers that are upset because we have been exiled from our children by unconstitutional legal orders.

However, none of my comments or any others made it to print. Only Joe Biden and Attorney General democratic candidate, Richard Cordray were quoted in the article.

I was the lone protester following the Newark Biden event Holding a sign that read; "Biden's pride: VAWA is unconstitutional." I was questioned quite frequently by people. Those who disagreed with my position claimed I was just upset because I was a sissy who had been beat up by his girlfriend. Many had no idea what VAWA was.

I have no pictures of myself, as I was there alone and surrounded, I did not feel comfortable entrusting someone to take my picture. I did take a few of the crowd.

Columbus, Ohio – September 28, 2008 --Fathers camped on the crane in Columbus make demands to Governor Strickland and Governor Schwarzenegger.

Still camped a top a crane near Ohio State University, Fathers 4 Justice members Paul Fischer , of Ohio and Donald Tenn of California released their demands. The dad's, dressed as super heroes released their demands to Ohio's Governor Strickland and California's Governor Schwarzenegger.

The fathers say, they will come down when the Governors from both states agree to a non partisan investigation into the family court system in their respective states. They insist that the investigation answers the questions; why is there gender bias in the family court system and why is there no perjury for false allegations?

"These fathers want and deserve answers," says,
Fathers 4 Justice, national board member, Brian Holladay, "They are up there making a statement for everyone who has suffered at the hands of the family courts. Nobody recognizes that fathers can't see their childern. Rediculous visitation schedules, un-inforced court orders and parential allienation along with false allegations create the problem. We need to stop this now."

When asked to comment, John Fowler, National Coordinator for F4J said, "These fathers have waited years for change. Their pleas have fallen of deaf ears. All they are asking for is to be able to love and raise their children. Why should children be denied the right to have two loving parents?"

Fisher and Tenn want answers, but they know the problems within the family courts extends throughout the United States.

The news of the situation in Columbus has spread across the US and Canada like wild fire. Web sites and blogs are flooded with pictures from the scene and comments of support for the fathers.

Lancaster City Police were called out to Penn Square at high noon last Saturday, August 30, in response to a demonstration by Fathers for Justice of PA/Families for Justice of PA. The group was holding a Constitutionally-protected public action on the square, and were holding up signs that said "HONK For Equal Custody".

An unidentified responding bike officer insisted that demonstrators take down the "honk" signs. A video of the encounter can be found on the group's website, F4Jpa.com, and viewers can hear the officer say, "Stop the cars - We'll get the point across real quick. Because you guys have signs that say "honk" you are causing people to break the law."

When organizers refused to take the signs down the officer talked into his shoulder and said, "Can we have as many units as possible to the area of Penn Square? We are going to do a little traffic detail."

After calling for extra police to begin pulling over cars, he said to the organizers, "You are going to have a lot of people upset with you because they're honking for you and they are going to get a citation because of that. I will definitely do what I need to do to get the honking stopped"

He then ordered the police who showed up, "One here, and one up there and we'll start stopping." They pulled two cars over immediately. With the threat of their supporters being stopped by police, organizer Jesse Sturm ordered the signs away. "Our hands were tied," said Storm. "We didn't want our supporters harassed, detained or arrested."

When contacted by the Post, Lt. Brent Oberholtzer said that while he didn't necessarily approve of saying horn-blowers would be cited, he argued that police have to deal with the noise and that they could stop people to find om why they were blowing their horns. "How do we know they are not just blowing their horns to make noise?," said Lt. Oberholtzer. "We have to deal with these quality-of-life issues," Lt. Oberholtzer acknowledged that city police officers pulled over several cars and threatened to cite supporters who blew their horns, but said that no one was actually cited, A check with the Magisterial District Judge confirmed this statement.

In a similar incident during the fall of 2005, at a political rally for then-Sen. Rick Santorum, city police cited Ben Vonderheide of DaddyJustice.com for "excessive horn blowing" while he was demonstrating against now-retired Judge Wayne G Hummer. In the summary trial before Magisterial Justice Judge Cheryl Hartman, Vunderheide was found "not guilty" with Hartman opining. "I am certainly not going to find someone guilty of doing what I have done at many a political events that I attended in the past. Blowing your horn is certainly free speech."

The city's noise ordinance was amended last fall to specifically exempt the very display of support that the officer wanted to stop, i.e., the "Expression or communication protected by the United States Constitution, including the First Amendment, or the Pennsylvania Constitution."

United States Constitutional attorney, Leonard Brown, Esq., of the Clymer & Musser law firm, said this about the incident: "The First Amendment protects political speech in the public square and may only be regulated by reasonable time, place and manner restrictions, While the officers did the correct thing in not arresting the holders of the signs, their actions of stopping cars that were engaged in symbolic speech is suspect at best."
